By accessing or using BufferAI's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Beta Service Notice

BufferAI is currently in private beta. The service is provided "as is" and may include bugs, errors, or interruptions. We may make changes to features, pricing, or availability at any time during the beta period.

3. Service Description

BufferAI provides an AI API proxy service that adds compliance, security, and policy enforcement features to AI integrations. We act as an intermediary between your applications and AI providers (e.g., OpenAI, Anthropic).

4. Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access
• You must be at least 18 years old to use our services
• During beta, accounts are provided on an invite-only basis

5. Acceptable Use

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Use the service for illegal content generation
• Resell or redistribute our services without authorization
• Abuse rate limits or attempt to circumvent security features

6. API Keys and Access

• API keys are confidential and must not be shared
• You are responsible for all activity under your API keys
• We may revoke API keys if we detect abuse or policy violations
• You must provide your own AI provider API keys (e.g., OpenAI keys)

7. Data and Privacy

Your use of our service is subject to our Privacy Policy. We process data as necessary to provide compliance and security features. You retain ownership of your data and are responsible for ensuring you have the right to process data through our service.

8. Fees and Payment

During the beta period, pricing may change. You will be notified of any pricing changes before they take effect. Fees are non-refundable except as required by law. You are responsible for costs incurred by AI providers (e.g., OpenAI usage fees).

9. Intellectual Property

BufferAI and its original content, features, and functionality are owned by Lucid Privacy, Inc. and are protected by international copyright, trademark, and other intellectual property laws.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or make changes to the service at any time. During beta, service interruptions may occur without notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUFFERAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold BufferAI harmless from any claims, damages, losses, liabilities, and expenses arising out of your use of the service or violation of these terms.

13. Termination

We may terminate or suspend your account at any time for violations of these terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the service will immediately cease.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance.

15. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
